Answer first
UK trade buyers should run two linked but separate checks. Vaping Products Duty (VPD) starts with the liquid: what it is, its volume and when it is produced or imported. Hardware checks start with the device and its route to market, including product rules, single-use restrictions and electrical-equipment responsibilities.
Key Takeaways - VPD is an excise duty on qualifying vaping liquid, not a separate charge calculated from hardware features. - Since 1 October 2026, the enacted VPD rate is £2.20 per 10ml of vaping liquid. - A prefilled device can require both workstreams: liquid-volume and duty-stamp evidence, plus device and packaging checks. - Keep one SKU file, but split the evidence into a liquid-duty lane and a hardware-compliance lane.
Put liquid duty and hardware checks in separate lanes
Classify the question before requesting documents. Under the Finance Act 2026, a VPD “vaping product” is a liquid meeting the statutory test, while a “vape” is the device that vaporises substances through a mouthpiece. Ask whether the liquid meets the statutory test, including where mixing is needed before vaporisation. HMRC says this reaches substances intended for vaping, including PG, VG and flavourings, whether or not the finished liquid contains nicotine (HMRC guidance).
Then ask the hardware question separately: what exactly is the device format, how is it configured for the UK market, and who is the relevant producer or importer? A bottle, prefilled pod and prefilled device may all create a liquid-duty record, but their device and packaging evidence will not be identical. For a category-level explanation, see e-cigarette product types in Great Britain.
The liquid lane: record volume, duty status and stamp evidence
VPD is charged on vaping products produced in or imported into the UK at £2.20 per 10ml, rounded down to the nearest penny (Finance Act 2026). Record liquid volume; battery capacity, device size and outer-pack dimensions are not the duty calculation basis.
For each relevant SKU, retain liquid volume, flavour, nicotine content, format, barcode and the responsible producer or importer. HMRC’s digital-stamp data includes volume to the nearest 0.1ml, product type, brand, flavour and nicotine content; positive-nicotine products also require an ECID or GBID (HMRC). This is a useful record design, not a liability decision.
For in-scope products, stamps belong in the liquid-duty lane. They must be affixed to outermost retail packaging so opening damages the packaging or stamp. Only digital stamps may be affixed from 1 January 2027; by 1 April 2027, products outside duty suspension must carry a stamp (HMRC). Establish each product’s status rather than rely on a general supplier statement.
HMRC includes wholesalers and retailers among affected businesses, and requires approved people to undertake proportionate supply-chain due diligence and keep records (HMRC notice). See VPD for wholesalers for distribution planning.
The hardware lane: check route-to-market requirements without redoing the duty calculation
Hardware screening tests product configuration and the responsible business; it does not recalculate VPD. For nicotine-containing consumer products in Great Britain, MHRA guidance covers notification and publication before sale, 2ml tank capacity, 10ml nicotine-containing refill-container volume and 20mg/ml nicotine strength (MHRA). A producer can be a manufacturer, importer or rebrander, and Great Britain and Northern Ireland use different notification systems.
Request product identifier, responsible entity, notification route where applicable, artwork and device configuration. Notification is a route-to-market requirement, not general product “approval”. See the UK vape packaging and labelling guide.
The single-use screen is also a hardware question. Defra says it has been illegal to sell or supply single-use vapes across the UK since 1 June 2025, defining these as non-refillable with a non-rechargeable battery (Defra). This does not show that the liquid is outside VPD. See what makes a vape reusable in the UK.
Electrical hardware can also raise producer-responsibility questions. A UK EEE producer can include a business that manufactures under its own brand, rebrands or commercially imports equipment; current guidance includes e-cigarettes and vapes among 15 EEE categories (Environment Agency). This is distinct from VPD responsibility.
Use one SKU intake record with two evidence columns
A single intake sheet avoids duplication, provided the questions are not mixed. The following is a concise planning checklist for adult UK trade teams.
| Checkpoint | Liquid-duty lane | Hardware-compliance lane |
|---|---|---|
| What is being assessed? | Whether the liquid meets the VPD definition and its recorded volume | The device, packaging, responsible entity and route-to-market requirements |
| Core evidence | Liquid ml, format, nicotine content, production/import status, duty/stamp status | Product identifier, configuration, notification route where applicable, artwork and EEE responsibility |
| Common error to avoid | Treating a device feature as the VPD calculation basis | Treating duty payment or a stamp as proof that hardware requirements are met |
| Escalate when | The liquid’s intended use, volume or duty-suspension position is unclear | The GB/NI route, reusable configuration, notification or producer role is unclear |

Frequently Asked Questions
Does VPD apply only to nicotine-containing liquid?
No. HMRC says VPD covers all substances intended for vaping and that liquids can be liable whether or not they contain nicotine. The statutory definition and any exclusions should be reviewed against the exact product and presentation (Finance Act 2026).
Is a reusable device automatically outside VPD?
No. Reusability is a hardware and sales restriction question. If a reusable device is sold prefilled with qualifying liquid, the liquid still requires its own VPD assessment by volume and status.
Does a vaping duty stamp settle every compliance question?
No. A stamp is part of the VPD traceability regime. It does not replace checks on notification, product configuration, packaging, electrical-equipment responsibilities or the applicable territorial route to market.
