Answer first
The Tobacco and Vapes Act 2026 is enacted, but its Part 6 advertising and sponsorship provisions remain prospective. The Government says it intends a UK-wide comprehensive ban from 1 June 2027. Trade teams should restructure public content around accurate, non-promotional product information while monitoring the promised legislation and guidance.
Key Takeaways - Treat 1 June 2027 as the Government’s intended commencement date, not as a restriction already in force. - Separate evidence-backed product facts from content designed to encourage a purchase, and apply that distinction across websites, social activity, print and sponsorship. - Do not assume a trade audience makes content exempt: the Act’s proposed trade-communication defence is specific and conditional. - Keep a policy register that distinguishes active rules, prospective provisions and consultation proposals awaiting an official response.
The intended 2027 regime reaches more than paid advertising
The planned change is a content-governance issue, not only a media-buying issue. The Tobacco and Vapes Act 2026, Part 6 contains prospective advertising and sponsorship provisions. Section 118 would cover business publication of an advertisement intended, or having the effect, to promote a vaping or nicotine product; section 121 would cover distribution. Both remain prospective on legislation.gov.uk, so they are not the present advertising rule.
DHSC says it intends to bring a comprehensive UK-wide ban on advertising and sponsorship of vaping and nicotine products into force from 1 June 2027. Its explanation includes paid website adverts, social-media advertisements and sponsored posts. It says retail websites can provide factual product information, while content designed to encourage purchase may be captured. See DHSC’s 2027 explainer.
Inventory web pages, social assets, catalogues, emails, partner material and sponsorship agreements. Record the asset owner and publication route: the same message can be reused in a different context.
There is an immediate reason to consolidate controls. From 29 October 2026, rules on free distribution and substantial discounts apply where the purpose is, or effect will be, promotion. Free samples and promotional giveaways must not be offered to members of the public. DHSC seller guidance sets out this active UK-wide rule, which is distinct from the prospective 2027 provisions.
Use a conservative factual-content test until official guidance is published
The practical distinction is whether information identifies or documents a product without trying to stimulate purchase. It is an editorial screening tool, not a substitute for the future guidance DHSC has promised. Revisit it when that guidance and formal commencement material are published.
| Content feature | Working classification for review | Editorial control |
|---|---|---|
| Accurate product identifiers, category, technical description and contents | Potentially factual when neutral and supported by records | Keep the source record and remove persuasive framing. |
| Required or regulatory information, age-of-sale wording and links to primary sources | Factual information | Version-control the text and cite the relevant official source. |
| A precise MHRA notification/publication reference where relevant | Factual status information | Do not describe publication as endorsement or a quality claim. |
| Superlatives, lifestyle-led imagery, urgency, rewards or language inviting purchase | Promotional indicators | Remove from public-facing content or refer for specialist review. |
| Free samples, coupons, promotional gifts or substantial-discount messaging | Current regulatory risk and promotional indicator | Remove and check the active rules before any use. |
Use verifiable records rather than sales language. For nicotine-containing e-cigarettes and refill containers in Great Britain, the MHRA says a producer includes a manufacturer, importer or re-brander; a retailer does not normally notify unless it also qualifies as a producer. The MHRA says publication on the relevant notified-products list is required before supply, but it does not guarantee compliance with labelling requirements. See MHRA advice for retailers and producers.
Aerova’s Compliance Centre and guide to MHRA notification and private-label responsibilities can help teams locate official material.
Build a review workflow that covers public and trade channels
Use a repeatable review workflow. Give every asset an owner, audience, distribution route, factual-claim evidence and outcome. Retain the live page or creative.
Keep public pages separate from genuinely trade-directed communications. The prospective general advertising defence requires a communication to be part of, and for the purpose of, a relevant trade and directed solely at defined relevant persons. These include people responsible for relevant purchasing decisions or in equivalent senior management positions. Section 125 does not make any “B2B” label, log-in area or trade mailing list automatically exempt. Record access conditions and recipient roles.
Before publication, confirm channel and audience; verify facts against a dated record; remove demand-creating claims or imagery; check commercial incentives against current rules; and route ambiguous content for review. Train editors, sales teams and agencies on the same process.
Use the same factual discipline for product presentation. Aerova’s overview of UK vape packaging and labelling and GB e-cigarette product types are relevant background when building an evidence file. Confirm the underlying requirement against official material before publication.
Keep the 2027 plan separate from proposals still awaiting decisions
A policy register should label each development by legal status, rather than treating every consultation as a new rule. The advertising and sponsorship measures sit in an enacted Act, but Part 6 remains prospective. DHSC says it will prepare secondary legislation and draft guidance before implementation. Monitor the intended 1 June 2027 date rather than presenting the restriction as currently operative.
Packaging, appearance and display need a separate status line. The UK-wide consultation on packaging, appearance and display closed on 2 October 2026. GOV.UK says a response will follow. Its proposals are not final law while that response and any later legislation are awaited.
Assign one owner to review DHSC, MHRA and legislation.gov.uk updates and archive the source.
Frequently Asked Questions
Is 1 June 2027 already the date on which the advertising ban is in force?
No. The Act received Royal Assent on 29 April 2026, but Part 6 is currently prospective. DHSC says the Government intends to commence the restrictions across the UK from 1 June 2027 and publish guidance beforehand. Monitor formal commencement material.
Can a retail product webpage still contain information after the intended restrictions begin?
DHSC says retail websites can provide factual product information. It also says material designed to encourage purchase may be captured. Keep content neutral, accurate and evidenced, and apply published guidance when available.
Does a B2B label make a promotional communication permissible?
Not automatically. Section 125’s prospective trade-communication defence has conditions on purpose, relevant trade and recipients. Treat eligibility as a documented assessment, not a channel label.
