Pre-filled Pod Kits and VPD: Documentation Questions for UK Trade

A UK trade documentation checklist for pre-filled pod kits, covering VPD, duty stamps, MHRA publication, reusable-vape evidence and packaging checks.

Answer first

UK trade buyers should assess a pre-filled pod kit as a traceable set of retail units, liquid volumes and records—not simply a device order. Before accepting supply, reconcile the SKU with MHRA publication where relevant, reusable-vape evidence, pack presentation, VPD information and the duty-stamp position.

Key Takeaways - VPD applies to vaping liquid whether or not it contains nicotine; compare volume across pack, invoice and delivery documentation. - From 1 April 2027, vaping products outside duty suspension in the UK must carry a vaping duty stamp. - An MHRA publication check for nicotine-containing products is valuable, but it does not replace a packaging review. - Retain evidence that a pre-filled pod format meets the reusable-vape definition, including separately available refill items.

Build the file around the exact sellable unit

Start with the exact retail unit: brand and variant, SKU or GTIN, pod count, liquid volume per pod and pack, nicotine strength where applicable, pack-artwork version and named supplier. This gives teams one common reference point.

For nicotine-containing electronic cigarettes and refill containers placed on the Great Britain market, MHRA guidance says products must be notified and published before sale. The MHRA ECIG database can be searched by identifier, submitter, brand and product type. Retain the GBID or ECID, submitter name, product type and search result with the purchase record.

Match the result to the actual presentation, not a broad brand assertion. MHRA retailer guidance says to check the published list and seek details to verify a product that cannot be found. It also makes clear that publication does not guarantee UK labelling compliance. For role-specific context when a business imports or rebrands, see MHRA notification and private-label responsibilities.

Ask VPD questions at SKU and consignment level

Vaping Products Duty applies to vaping liquid, including liquid without nicotine. HMRC’s current rate is £2.20 per 10ml. Where records differ, HMRC may use the greatest volume shown on retail packaging, an invoice, delivery note or actual measurement. Consistent volume evidence is therefore a trade control.

Request the volume for each pod and the total in the supplied retail unit, then compare it with the pack, invoice and delivery note. Record it against the SKU and consignment. If an importer, manufacturer, warehousekeeper or UK representative is involved, identify the party responsible at the duty point and whether goods are under duty suspension. A wholesale buyer should not assume it performs the same approved activity as the business that manufactures, stores under suspension or handles stamps.

HMRC confirms VPD began on 1 October 2026. Its VPD and duty-stamps guidance says all vaping products outside duty suspension in the UK must have a duty stamp from 1 April 2027. See our UK Vaping Products Duty guide for wholesalers.

Make the duty stamp part of the traceability record

A duty stamp must sit on outermost retail packaging so opening damages the packaging or stamp. HMRC describes digital stamps as having a scannable feature for authentication and supply-chain tracing. They are not merely a label check.

For a pre-filled pod SKU, HMRC’s duty-stamp guidance lists product data including GTIN/barcode, volume to the nearest 0.1ml, brand, flavour, product type, nicotine content and, above 0mg/ml nicotine, an ECID or GBID. “Prefilled pod” is a listed type. Ask for written confirmation mapping those fields to the supplied SKU.

Record stamp presence and condition on the relevant retail packaging, keep consignment references and investigate mismatches before stock is released. Transitional stamps were available to purchase until 30 November 2026; only digital stamps may be affixed from 1 January 2027. The record should connect the commercial SKU, physical pack and supplier documentation.

Keep reusable-format, packaging and end-of-life evidence together

A pre-filled pod system is not automatically reusable. Under Defra’s single-use vapes business guidance, a reusable vape must have a rechargeable battery, a refillable container and, if it has a coil, a removable and replaceable coil. Separately available pre-filled pods can provide the refill route; a coil in a replaceable pod or cartridge can meet the coil condition.

The ban on selling or supplying single-use vapes has applied since 1 June 2025. Businesses must be able to evidence that products are legal and reusable, including separately available refill items. Retain information supporting the design, refill availability and, where applicable, coil arrangement. Use the UK reusable-vape checklist to structure the questions.

Also preserve current pack artwork or an image. For nicotine-containing products, compare it with MHRA packaging guidance for Great Britain, covering misleading claims, food/cosmetic-like presentation, environmental claims and offers. See the UK vape packaging and labelling guide for a trade checklist.

Vapes are electrical and electronic equipment. OPSS and Defra WEEE guidance says distributors must offer free WEEE takeback, retain records for at least four years and provide written information about the service. Allocate records to the appropriate trading entity.

FAQ

Does every pre-filled pod kit need an MHRA check?

For nicotine-containing electronic cigarettes and refill containers supplied in Great Britain, check relevant publication and the exact presentation. A kit may include several regulated elements, so retain identifiers for the supplied SKU. Products without nicotine can fall outside TRPR notification scope, but other product rules can apply; VPD applies whether or not liquid contains nicotine.

What if the invoice volume differs from the pack volume?

Pause the stock record and seek a written explanation. HMRC may use the greatest volume shown on packaging, invoice, delivery note or measurement, unless it agrees an exception. Keep corrected documents before planning.

Is a duty stamp alone enough documentation?

No. Pair it with the SKU record, volume evidence, consignment information, relevant MHRA search, pack review and reusable-format evidence. A stamp supports traceability, not every condition applying to supplied stock.
